Definition
The Dog Club is the trading name of Jessica Gilmour, a sole trader. Our licensed business is based at Hatfield Road, Maldon, CM9 6QD
TERMS & CONDITIONS (“the contract”)
The client’s attention is particularly drawn to the provisions of Clause 23.
Bookings
1. By a) enrolling a dog with or b) permitting a dog to attend or c) accepting the Services of The Dog Club and its staff, the Client is deemed to have accepted these Terms and Conditions.
2. The Dog Club may act in the Client’s absence as guardian of their dog and may perform or take any action which they deem necessary in order to protect and keep in good health the Client’s dog.
3. An in-home consultation or visit to the facility is required, prior to all reservations, for all new clients.
4. After a successful in-home consultation or visit to our facility, a trial day is required to ensure suitability of your dog to our day care.
5. The Dog Club will provide time intervals during which pick up and drop off services will occur. If an unforeseen circumstance arises, the time interval may be adjusted. You will be notified in this instance.
6. All bookings must be made at least 24 hours before arrival date and only after a successful Trial and Meet & Greet has taken place.
7. Please provide anything your dog requires throughout the day such as food, medication and a collar or harness.
8. The Dog Club operates a fixed day care booking system, whereby the Client commits to regular day/s per week.
9. The Client is required to provide a minimum of 7 days’ notice to The Dog Club (in writing) if their dog (s) is not attending on their agreed regular day/s, subject
10. Therefore, if the Client does not send their dog for any reason and fails to provide a minimum of 7 days’ notice to The Dog Club, for example due to holiday or sickness, the monthly fee for the agreed regular day/s is still payable in full.
11. The Dog Club allows a maximum of a 1-week break (unpaid) from day care within a 4-week period, subject to a minimum of 7 days advance notice being provided.
12. If additional time away from day care within a 28-day period is required, full payment for the additional absent day/s will be required if the Client is to retain their agreed regular day/s.
Fees & Payment
8.The Client may swap their agreed regular days on an ad hoc basis subject to availability. It may be possible to add occasional extra days as required, subject to availability. Requests to do so should be made via xxxxx, the online booking system.
9. Full payment for services (agreed either at time of booking or subsequently) is to be made within 7 days of receipt of invoice or, by the date specified on the invoice if not already paid using the online booking service. Time for payment shall be of the essence of the Contract. The preferred method of payment is using the online booking system, via Stripe. BACS transfer (with your surname and your dog’s name as reference). If the Client fails to make any payment due to The Dog Club under the Contract by the due date for payment, then the Client shall pay interest on the overdue amount at the rate of £5 per day. The Client shall pay the interest together with the overdue amount plus any and all additional administrative, debt collection costs and legal fees incurred.
10. The Client shall pay all amounts due under the Contract in full without any set-off, counterclaim, deduction or withholding (except for any deduction or withholding required by law). The Dog Club may at any time, without limiting its other rights or remedies, set off any amount owing to it by the Client against any amount payable by The Dog Club to the Client.
11. On termination of the Contract for any reason the Client shall immediately pay to The Dog Club all of The Dog Club ’s outstanding unpaid invoices and interest and, in respect of services supplied but for which no invoice has been submitted, The Dog Club shall submit an invoice, which shall be payable by the Client immediately on receipt.
12. Invoices will be sent every Friday following your dog’s attendance with us. Payment is required by the following Monday. However, if you wish to pay on the day, please let us know.
13. For clients who are booking trial days for their dogs, we require payment in advance.
14. Where payment is overdue, a penalty of £5 of the final invoice amount will be added per day payment is not received, up to a maximum of 20 days. After this, further action may be taken.
15.Where payment is not received in accordance with these terms and conditions of business, The Dog Club reserves the right not to proceed with any previously agreed arrangements and a cancellation fee will be payable.
Cancellation
17. The Dog Club requires 7 days’ notice of any cancellation. The Client agrees to provide such notice or pay the amount that would be due during this notice period. The Client may cancel with notice at any time; there is no minimum term of contract.
18. In the very unlikely event, The Dog Club is unable to provide the agreed service, we will do our best to rearrange or offer an alternative unless in extreme circumstances in which they will endeavour to provide 24 hours’ notice.
19. The Dog Club is closed on Christmas Day, Boxing Day, New Year’s Eve and New Year’s Day.
Insurance
20. The Dog Club is fully insured for the provision of dog day care services including valid public liability for the peace of mind of our clients. A copy of our insurance is available on request.
21. All reasonable care is taken to ensure the integrity and suitability of the care provided.
22. The insurance only covers The Dog Club for the duration of the selected services and only for services arranged with The Dog Club.
Liability
23. The client’s attention is particularly drawn to this clause
23.1 The Client take responsibility for any costs which may be incurred, by either veterinary or other parties, as a result of any damage, accident, or sickness caused to or by their dog and will pay any such costs or expenses on demand.
23.2 Nothing in the Contract shall limit or exclude The Dog Club liability for:
23.2.1 death or personal injury to a human being caused by its negligence, or the negligence of its employees, agents or subcontractors;
23.2.2 fraud or fraudulent misrepresentation; or
23.2.3 breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law.
23.3 Subject to clause 24.2, The Dog Club shall not be liable to the Client, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
23.3.1 loss of profits;
23.3.2 loss of sales or business;
23.3.3 loss of agreements or contracts;
23.3.4 loss of anticipated savings;
23.3.5 loss of damage to goodwill; and
23.3.6 any indirect or consequential loss.
23.4 Subject to clause 24.2, The Dog Club’s total liability to the Client, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to £1,000 or the total fees paid under the Contract, whichever is lower.
23.5 The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Contract.
23.6 This clause 23 shall survive termination of the Contract.
23.7 In agreeing to the figure set under clause 23.4 above the Client agrees that he/ she is able to insure the Client’s dog under a pet insurance policy and is likewise able to insure home and property contents under a house and contents insurance policy. The Client is advised to notify his/her insurers of the day care arrangement in order to be covered under the pertinent insurance policies. The Client understands that The Dog Club is only able to offer its competitive fees on the basis of its Clients insuring its pets appropriately.
Emmipet Ultrasonic Teeth Cleaning
All dog owners wishing to schedule an ultrasonic teeth
cleaning must first attend a consultation. If we determine
during this consultation that we cannot use the ultrasound
toothbrush on your dog, a portion of your consultation fee can
be applied towards dental health products, dental sticks, or
treats.
The initial session will last approximately 30 to 35 minutes.
Following this, we will provide guidance on the most suitable
treatment plan for your dog.
The cleaning service offered by The Dog Club is intended as a
preventative measure rather than a cure.
Since every dog is unique, we cannot guarantee specific
results or the exact number of appointments needed to
complete the treatment plan. Generally, 5 to 10 sessions are
required before transitioning to maintenance appointments.
Maintenance sessions will last between 15 to 20 minutes and
can be arranged in consultation with our grooming team.
These should take place every 4 to 8 weeks after the initial
treatment is completed and once your dog’s teeth are in good
condition.
The Dog Club Team will utilise the Emmi-pet ultrasound
toothbrush, which operates silently and without manual
movement.
Whenever possible, our staff will capture before and after
photos to document your dog’s dental health progress.
Results will vary based on each dog’s current dental health,
diet, previous dental visits, and behavior during the sessions.
Thus, your dog’s progress may differ from that of others.
By scheduling a teeth cleaning appointment, you acknowledge
that the cleaning aims to maintain dental and gum health.
Tartar, plaque, stains, and bacteria will be gradually eliminated
from the teeth during the treatment sessions.
Some minor bleeding at the gum line may occur during or after
the teeth cleaning process as tartar and plaque are broken
down. The ultrasound technology promotes increased blood
flow, which aids in healing the gums and eliminating bacteria.
The Dog Club grooming team reserves the right to refuse or
discontinue treatment if:
- There are any loose or fractured teeth.
- The gums are severely inflamed or receding.
- The client exhibits stress or aggression, putting
themselves or staff at risk.
- Any noticeable abnormalities are present or suspected in
the mouth, including but not limited to:
- A foreign body lodged in the mouth
- Oral warts
- Oral injuries or tumors
If a session is canceled due to a decision made by our staff,
you will receive a refund minus a £15 brush charge.
The Dog Club grooming team will not continue with any dental
treatment if we believe you should seek veterinary advice.
By utilising our services, you agree that The Dog Club
grooming is not liable for any damage, loss, or claims arising
from any condition related to your dog. It is further understood
that the terms of this agreement may change at any time
without notice and will supersede all previously signed
contracts or releases.
When it is necessary to replace your toothbrush head, a fee of
£15 will be charged to cover the cost. The timing for
replacement will vary per dog, depending on whether they
attempt to chew it; however, we recommend replacing it every
three months.
Health and Medical Conditions
Procedures within the grooming environment can be stressful for
some dogs, especially for senior, young, overweight dogs or those
with medical concerns. The process may expose unknown medical
conditions or aggravate a current one during or after the groom. In
the best interest of your pet this agreement will give The Dog Club
Grooming permission to seek emergency veterinary treatment if we
deem it necessary for whatever reason. We will do the best to
contact you first, before taking your pet for treatment, however this
may not always be feasible. Unless we are deemed to be negligent
all medical expenses are the responsibility of the owner.
By
agreeing to these Terms and Conditions you are expressly agreeing
to the following disclaimer:
Elderly, Infirm, Overweight or Young Dogs Disclaimer
A full groom can take in-excess of 3 hours and is physically
demanding as well as stressful for some animals. Whilst The Dog
Club Grooming make every effort to provide additional support to
elderly/infirm/overweight and young dogs we cannot guarantee that
your dog will be able to adequately support themselves for the
duration of the groom which may result in serious health risks.
There is also an increased risk of other injuries such as cuts and
grazes. The Dog Club Grooming reserve the right to stop the
grooming process at anytime with payment in full being due on
collection of your dog.
Vaccinations
By using our services, owners confirm that their dog is up to date
with their annual vaccinations against Canine Distemper, Infectious
Canine Hepatitis, Leptospirosis, and Canine Parvovirus. An
unvaccinated dog may put itself and others at risk. The Dog Club
Dog Grooming takes no responsibility for any dog that may contract
any of the aforementioned diseases.
The Dog Club Grooming may ask for proof of vaccination and
veterinary information which must be provided.
Fleas & Ticks
The Dog Club Grooming is proud to be a tick/flea free environment.
If your dog is known to have a parasitic infestation, we ask that your
grooming appointment is rescheduled to a time when your pet is
free from said infestation. 48 hours notice must be provided to avoid
a cancelation charge. We recommend that you contact your
veterinary surgeon to provide you with the best recommended
treatment. If fleas are found on your dog, we will use a flea
shampoo and be required to do additional disinfection of our
premises and equipment. An additional £15 will be charged to your
bill. If ticks are found an additional £5 will be charged to include
removal. We will not be held responsible for any infection caused by
the tick or removal thereof.
Coat Condition
The Dog Club Grooming practice humanity over vanity. If we are
presented with a neglected coat and believe, in our professional
opinion, it is kinder to remove the coat than it is to de-mat this will
be done in accordance with The Animal Welfare Act 2006. Whilst
we will make every effort to identify this as part of the pre-groom
consultation and coat assessment there may be occasions where
the degree of matting cannot be fully identified until we commence
the groom.
In this event we will make every effort to contact you however if this
is not possible we will, in our professional opinion, do what we
believe is in the best interest of the welfare of the dog.
By agreeing
to these Terms and Conditions you are expressly agreeing to the
following De-Matting disclaimer:
De-Matting Disclaimer
Under the Animal Welfare Act 2006, it is an offence to cause
unnecessary suffering to an animal: – this includes prolonged ‘de-matting’ which is painful and detrimental to the welfare of the dog. If
you bring in your dog with more than 15 minutes of de-matting
work, we are required by the Act to clip your dog short humanely or
refer you to your vet to do the same. We will only attempt to de-matt
5% of a dog – which equates to about 50p sized mat behind each
ear, same size in the armpits and perhaps one or two in the groin or
tail area. We have assessed your dog’s coat and found it to be
matted, therefore it needs to be clipped short. This can be
prevented by daily brushing with a slicker brush and comb. Will be
happy to explain the correct way to brush your dog and suggest a
grooming programme that will allow us to achieve the look you
would like for your dog, this may involve more frequent visits to our
salon and will certainly involve daily grooming at home. When a
dog’s coat becomes matted, it causes discomfort as the matts pull
tightly on the skin and underlying health conditions may not be
visible. When a matted coat is clipped short, it may occasional
reveal sore, reddened and irritated skin, this is due to the fact that
the skin has not been able to breathe, and air circulation is not
restored. Clipping a matted coat can take longer and cause additional wear and tear on our equipment so a further fee may be
chargeable in addition to the normal groom price.
The process of de-matting increases the risk of injury including but
not limited to cuts and grazes, skin irritations caused by the
shortness of the clipper blades that will be used as well as possible
haematomas. In addition, you may see some behavioural changes
such as head shaking, excessive scratching, licking and “scooting”.
This is where the dog will scrape their back end on the floor to relive
itching and irritations. Should you have any concerns you should
seek advise from your usual vet.
Additional charges may be incurred due to the wear on equipment,
additional products used, as well as time and skill needed to
remove matting.
Behavioural Charges
Aggression
Owners have the obligation to inform The Dog Club Grooming of
any known aggressive behaviour traits their pet may have to other
animals or humans. Specifically, the owner must inform The Dog
Club Grooming if they have been advised by pervious groomer(s) of
any of the aforementioned behaviours.
Nervous/Anxious Dogs
Although The Dog Club Grooming caters to dogs with nervous
traits, owners have the obligation to inform us of any such
behaviours in order for us to cater to their needs to the best of our
ability.
Behavioural charges will be decided by The Dog Club Grooming
depending on the severity of the behaviour and the time, skill, and
equipment required to groom the dog. If your dog should bite you
agree to be responsible for all related medical and or Vet bills, loss
of earnings and equipment damage. We reserve the right to refuse
service if we believe your dog may become a danger to itself or
those within the salon. In the event any of these behaviours present
during the groom the session may stopped at anytime and the full
fee incurred.
Please toilet your dog before attending their appointment. Fouling in
the salon may result in additional charges.
Time Keeping
The Dog Club Grooming works to a strict time frame to ensure that
your dog receives ample grooming time and one-to-one care. We
expect to admit you at your given appointment time, if you are early
we may not be able to grant immediate access and would ask that
you wait until you allocated time. Likewise, if you are more than 15
minutes late we will may have to refuse your groom on welfare
grounds as rushing the groom may lead to unnecessary stress and
possible injury. A fee equal to the cost of the groom will be incurred.
If you are more than 15 minutes late collecting your dog a late
collection charges will be incurred.
Pricing
All prices provided are an estimate only and include VAT at 20%.
VAT
Additional charges may be incurred due to:
- Overweight dogs or oversized for the breed
- Unkept/neglected coats
- Aggressive, senior, nervous or timid dogs that require additional
handling
- Fleas and/or ticks
- Dogs that require additional handling for whatever reason
Cancellations
We require 48 hours notice for cancelled appointments or the full
grooming charge will apply and must be paid in full before re-booking.
General
The Dog Club are unable to groom pregnant or in season bitches
and will not provide services for any dogs noted under the
Dangerous Dogs Act. Should your Bitch be in season during the
time of a pre-booked appointment 48 hours notice must be provided
to avoid the cancellation charge noted above.
Hold Harmless Agreement
By using our services you agree to hold The Dog Club Grooming its
owners, employees and directors harmless from any damage, loss,
or claim arising from any condition of the dog, either known or
unknown to us. It is also further understood and agreed the terms of
this agreement can change at any time, without notice, and will
overwrite any and all prior signed contracts or releases. It is further
understood this clause applies to any and all dogs groomed.
GDPR Statement
In order for us to provide the requested services, we are required to
obtain and store a limited amount of your personal information.
Such information will be stored in accordance with all relevant
legislation, will never be shared with any 3rd parties or
organisations and will only be used for the purposes of providing
the requested or related services. You have the right to request and
review any of your personal information. Please make any requests

date and only after a successful induction day is complete.
7. Please provide anything your dog requires throughout the day
such as food, medication and a collar or harness.

the dogs temperament unsuitable for a daycare environment.
Cancellation
The Dog Club requires 24 hours notice of any cancellation for
daycare services. The Client agrees to provide such notice or pay
the amount that would be due during this notice period. The Client
may cancel with notice at any time; there is no minimum term of
contract.

Deposits, Cancellations and payments for OVER NIGHT HOME
BOARDING at The Dog Club
1.All pets will be charged boarding for the day of arrival following
a full day of day care – £15:00 for adults – £20:00 for puppies. If
collected before 9:00 am on the date of departure no charge
will be made for that day. Late checkouts are between 9.30 –
11.00 pm and must be pre-booked and chargeable (£20.00)
after 11.00pm will be charged at a full daycare rate – £33.00 for
adults £35.00 for puppies.
2. All deposits are non-refundable and non-transferable.
3. A minimum non-refundable deposit of 25% which can be paid
via the online booking system – only once a deposit has been
paid will a booking be confirmed.
4. All outstanding balances must be paid 1 calendar month prior to
check in to secure a booking, once paid the full balance is then
also non-refundable & non transferrable, any booking made
within 1 calendar month will require payment in full at time of
booking.
5. 1 calendar months prior notice must be given to cancel a
booking, or the full balance will be non-refundable & non
transferrable.
6. Any booking cancelled with more than 1 calendar months’ notice
will be entitled to a refund minus the deposit paid to hold the
dates.
7. No refunds will be given under 1 calendar months’ notice which
is also applicable to amended/reduced bookings, any reductions
must be made before the 1-month deadline.
8. Any cancellations or amendments must be in written form to our
email address – jessica@thedogclubmaldon.co.uk or via your
online booking account.
9. Any booking cancelled due to any reason, such as Pandemics,
will still have our normal terms & conditions applied to protect
our business.
10. If the client collects their dog earlier than the agreed date, they
are liable to pay for the original booking costs, no refunds are
given.
11. We reserve the right to revise our prices when necessary, rates
will go up on the 1st January each year, these will be displayed
on our website & in our reception.
Insurance
